Photography & Video Release – Sport-Shutter LLC

PHOTOGRAPHY & VIDEO RELEASE AGREEMENT

This Photography & Video Release Agreement (“Agreement”) is entered into in consideration of my engagement as a model and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged. I hereby grant the following rights and permissions to Sport Shutter LLC, its members, employees, contractors, legal representatives, successors, and assigns, and those acting with its authority and permission (collectively, the “Photographer”).

Grant of Rights

I grant the Photographer the irrevocable, perpetual, worldwide, and unrestricted right to photograph, video record, and otherwise capture my likeness, image, voice, and appearance, and to use, reuse, publish, republish, distribute, display, and reproduce such photographic portraits, pictures, and/or video, in whole or in part, either alone or in combination with other images, text, graphics, or media. Such use may include composite, altered, cropped, or distorted images, with or without my name, or with a fictitious name, in color or otherwise, through any medium now known or hereafter developed, including but not limited to print, digital, internet, social media, advertising, marketing, editorial, promotional, artistic, and commercial purposes.

Alterations & Creative Control

I specifically consent to digital compositing, retouching, or alteration of the images, including but not limited to changes in color, size, shape, perspective, context, foreground, or background. I understand and agree that complete creative control is retained by Sport Shutter LLC.

Waiver of Approval

I waive any right to inspect or approve the finished product, advertising copy, captions, text, or other matter that may be used in connection with the images or the use to which they may be applied.

Commercial Use Acknowledgment

I understand and agree that images of me may be used in, but are not limited to: Websites; Social media platforms; Marketing and promotional materials; Advertisements; Department, merchandise, or electronics stores. I consent to such use without restriction.

Release of Liability

I hereby release, discharge, and agree to hold harmless Sport Shutter LLC and all persons acting under its authority from any and all claims, demands, damages, or liabilities arising out of or related to the use of the images, including but not limited to claims for libel, defamation, invasion of privacy, violation of the right of publicity, distortion, alteration, optical illusion, or composite use.

Assumption of Risk

I acknowledge that participation in a photography session involves inherent risks. I voluntarily assume all such risks and agree that Sport Shutter LLC shall not be liable for any injury, loss, or damage sustained during the session.

RAW Image Policy

RAW or unedited digital images will not be provided under any circumstance. All images will be used and shared in a tasteful and respectful manner.

Athlete Participation Acknowledgment

The guardian and/or client understands that the photographer is limited by the willingness of the athlete to participate in the photo session. It is the responsibility of the guardian and/or athlete to ensure participation in all allotted poses.

Representations

I represent and warrant that: I am at least 18 years of age or I am the parent or legal guardian of the minor named below; I have the legal authority to enter into this Agreement; The information provided is accurate.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law principles.

Electronic Acceptance & Signatures

I understand and agree that by typing my name, checking a box, clicking “I Agree,” or signing electronically, I am executing this Agreement electronically. I acknowledge that electronic acceptance constitutes a legally binding signature to the fullest extent permitted by law.
